The applicant explained the wells were never used before hydrologic studies confirmed they're hydrologically disconnected, and that spotted owl surveys — including surrounding landowner call data — found no owl hits in the area.

In a letter received the day before the hearing, BLM asked for a boundary survey, raised northern spotted owl habitat and access-easement damage concerns, and noted cannabis remains federally prohibited. Staff responded that existing cultivation is already 1,700 feet from the BLM boundary, owl surveys were negative, and projects access only Highway 36.
